Summary

EIN is launching a series of six country reports on the state of implementation of judgments of the European Court of Human Rights (ECtHR). In this report, we examine the implementation record of Azerbaijan, which is in great need of improvement.

Cases pending implementation in Azerbaijan involve the arbitrary prosecution of human rights defenders, journalists and activists; restrictive legislation governing NGO activities; and violations of the right to free and fair elections (among many other issues).

As of November 2020, there are 43 leading ECtHR judgments against Azerbaijan still pending implementation. These all highlight serious and/or systemic human rights issues, which are likely to recur unless the cases are implemented. On average, leading cases have been pending for over 7 years

In the past 10 years, Azerbaijan has implemented only 2 out of 28 leading judgments. The remaining 26 judgments recently issued by the ECtHR (and the systemic human rights issues they identify) have not yet been implemented.

We hope that this report will serve as an informative basis for future work on Azerbaijan's implementation of judgments.
